General Terms and Conditions of Business
1. General
These terms govern the contractual relationship between MT.8848 and customers using our online shop. By placing an order, you agree to these terms. Any deviations must be explicitly agreed upon in writing.
2. Prices and Shipping Costs
All prices are listed in Euros (€) and include applicable VAT unless stated otherwise. Shipping costs are calculated during the checkout process and displayed before finalizing your purchase.
3. Ordering / Conclusion of Contract
Orders are placed through our online shop and constitute a binding offer to purchase the selected products. A contract is concluded when we send an order confirmation email or dispatch the goods.
4. Delivery
We aim to deliver promptly; however, delivery times are estimates and may vary. We are not responsible for delays caused by factors beyond our control, such as customs clearance or force majeure.
Right of Cancellation and Consequences
Customers have the right to cancel their order within 14 days without providing a reason. To cancel, you must notify us in writing or via email. Upon cancellation, all payments, including shipping costs, will be refunded within 14 days of receiving the returned goods.
5. Return
Products must be returned in their original condition and packaging. Customers bear the cost of return shipping unless the product is faulty or incorrect. Returns should be sent to the address provided in our returns policy.
6. Payment Methods
We offer the following payment methods:
Payment before delivery
Card payment
When placing the order, you can pay with a valid credit or debit card (VISA, Mastercard or American Express) and enter the card information. The corresponding amount is immediately reserved on your card, but is not debited until the goods have been dispatched from our warehouse. MT.8848 reserves the right to check the validity of the card, the available credit in relation to the order value and the buyer's address details. Based on the results of this check, we may also refuse orders.
PayPal
If you use PayPal as a payment method, the corresponding amount will be immediately reserved in your PayPal account, but will not be debited until the goods have been dispatched from our warehouse. MT.8848 reserves the right to check the validity of the PayPal account, the balance to cover the order value and the buyer's billing address. We may also reject orders based on the results of this check.
Apple Pay
When you pay with Apple Pay, MT.8848 reserves the right to check the validity of the Apple Pay account and the validity of the credit or debit card, as well as your credit status in relation to the order value. Based on the results of the check, we may also refuse orders.
The corresponding amount will be immediately reserved on the card you selected, but will not be debited until the goods have been dispatched from our warehouse.
Pay immediately
The "Pay immediately" service is provided by Klarna.
You pay securely via direct bank transfer using your usual online banking. Your online banking details are only entered in Klarna's secure payment form. Gift card
You can pay for all or part of your order placed on our website with MT.8848 gift cards. A maximum of 10 MT.8848 gift cards can be used per online order.
Payment after delivery
Pay later
Our Pay later service is provided by Klarna. When your order has been dispatched, you will receive a communication from Klarna about how and when you can pay. For more information and questions about payment, please visit klarna.com or contact Klarna customer service.
Miscellaneous
The legally required invoice will be included in the shipping confirmation email.
7. Warranty
Nothing in these terms and conditions shall exclude or limit MT.8848's liability where this would conflict with applicable laws regarding exclusion or limitation of liability.
MT.8848 accepts liability for death or personal injury caused by our negligence or that of our employees and agents. We do not intend to exclude liability for fraudulent misrepresentation by us, our employees or agents. If we breach these terms and conditions, we will only be liable for losses that are a foreseeable consequence of such breach.
MT.8848 is not liable for indirect damages arising as a side effect of the actual loss or damage, such as loss of profits or orders, or for non-delivery of products or failure to comply with other obligations under these Terms and Conditions if the cause of such non-compliance is beyond our control, including but not limited to fire, flood, storm, riot, civil unrest, war, nuclear accident or terrorist activity.
Our maximum liability to you for any loss or damage arising from your order on hm.com is limited to the total amount of your order.
8. Colors and Dimensions
We make every reasonable effort to accurately display the characteristics of our products, including their composition and colors. However, your display of colors will depend on your computer system and we cannot guarantee that your computer will accurately display colors.
The measurements of a product on mt8848.info are approximate only to give you a more accurate idea of how a garment will fit. The actual measurements of a product will vary depending on the material used to make it.
9. Guarantee
If the goods purchased are defective, MT.8848 undertakes to comply with all applicable guarantee provisions. If you have a complaint regarding obvious material or manufacturing defects in the goods we provide, including damage caused during transport, please return the goods to us immediately and use the enclosed return slip.
10. Assignment
MT.8848 reserves the right to assign or pledge all payment claims arising in connection with the delivery of goods, including all payment instalments, to third parties.
11. Validity
If any part of these provisions is unlawful or is declared invalid by a court or regulatory authority, the remaining provisions will continue to be valid.
12. Retention of title
All intellectual property rights, such as trademarks and copyrights on hm.com remain with MT.8848 and its subsidiaries or licensees. Use of mt8848.info or its content, including copying and storing content in whole or in part, other than for personal, non-commercial purposes, is not permitted without the permission of MT.8848.
